Perfect Start terms of service. Provider and commercial placeholders still require legal review before paid access opens.

Perfect Start terms of service

These terms explain the rules for an account holder, a rider, a parent or guardian managing a rider, and an organisation operating Perfect Start sessions. They do not replace the Privacy Notice or the clear choices shown before a rider is filmed.

Your complete agreement pack

You agree to these Terms of Service, version 4, and the Privacy Notice, version uk-standard-2026-09-26. The sections below are the complete Terms of Service—not a shortened sign-up copy. Sections only apply when they describe a role or activity you actually have.

1. The service and these terms

  1. Perfect Start records a BMX start, analyses movement of the rider and bike on our servers, and returns a server-rendered replay and measurements. It is a practice and feedback tool. It is not a race timing system, medical device, safety system, talent-selection service or substitute for a qualified coach.
  2. By creating an account or using the service after the final effective date, you agree to these terms. If you act for a club or another organisation, you also confirm that you are authorised to bind it to the Club Schedule. Optional choices about research, club sharing, leaderboards or marketing are not agreement to these terms and will be requested separately.
  3. If an operator presents these terms at a session, each rider or authorised adult must still receive the recording notice and make the choices required for that rider. A club cannot accept a child's filming permission on behalf of a parent or legal guardian unless applicable law and documented authority permit it.
  4. We may update these terms prospectively. We will identify the new version, explain material changes, give any notice required by law and ask you to agree again when you next sign in. A rider's QR card cannot be used for a new run until the account responsible for that rider has accepted the current version. Archived versions will be available at [URL].

2. Accounts, rider profiles and authority

  1. An account belongs to the signed-in person or organisation. A rider profile belongs to the rider even when an adult manages it. A club session, subscription or roster link does not transfer ownership of a rider's history to the club.
  2. You must provide accurate information, protect the device and sign-in method used for your account, and tell us promptly at [SUPPORT EMAIL] if you suspect unauthorised access. You are responsible for authorised activity, but not activity caused by our failure to use reasonable security.
  3. You may create a profile for yourself or for a child only if you are the child's parent or legal guardian, have the legal authority required to make the requested decisions, and provide accurate age and relationship information. A coach, volunteer or club officer is not automatically a guardian.
  4. You must not create or claim a rider profile for another adult, impersonate a rider, scan or copy another rider's code without authority, or knowingly assign a recording to the wrong rider. Tell us immediately if a run is misassigned.
  5. We may require reasonable evidence of age, identity or authority, designed to collect no more information than necessary. We may pause capture or sharing while authority is checked.
  6. When a child becomes able or entitled to manage their own profile, we will provide an appropriate transfer or shared-management process. The managing adult must cooperate and must not withhold the rider's history contrary to law.

3. Children, consent and filming

  1. A child may be filmed only under the age and guardian rules shown in the service for the country and session. Accounts are currently for adults aged 18 or over. A child may be filmed only when the account holder is their parent or legal guardian and is physically present for the run. An operator must stop if those requirements are not met.
  2. Before capture, the rider and, where required, their parent or legal guardian will be told in suitable language: that video and microphone capture will occur; that the footage is uploaded for cloud analysis; what movement data and replay are produced; who can see them; how long each is kept; and how to refuse or withdraw.
  3. Required permission for capture and short-term storage is separate from optional permission for wider club sharing, product research, leaderboards, public sharing and marketing. Optional choices must not be pre-selected and refusal must not be disguised or punished.
  4. The adult giving a child's permission confirms that they have legal authority and have considered the child's wishes. A rider can ask the operator to stop at any time. We may refuse to film where the child objects, authority is disputed or safeguarding concerns arise even if an adult has agreed.
  5. A venue's or club's general photography waiver does not, by itself, authorise Perfect Start's cloud recording, analysis, storage, research or sharing. Our in-product permissions still apply.
  6. Session operators must use the designated filming area, warn nearby people, avoid filming bystanders, never use hidden capture, and stop where someone enters the frame. Contact [SAFEGUARDING EMAIL] about accidental capture or a safeguarding concern.
  7. No term waives a child's privacy rights, our safeguarding responsibilities, liability that law does not permit us to exclude, or the right to report a concern to police, a regulator, a governing body or safeguarding authority.

4. Recordings, analysis and rider results

  1. You grant us a limited permission to host, copy, analyse and render material submitted to the service only for the purposes and period described in the Privacy Notice and the choices made for the rider. You retain any rights you have in your submitted footage.
  2. Source footage includes sound. We currently use it for cadence alignment and retain it in the replay so the rider can hear the gate beeps. The launch notice must state whether sound is recorded. Do not submit music or content you do not have the right to provide.
  3. We delete source and rendered videos from our servers 30 days after the start is recorded. A scheduled job runs every night and removes everything past that point; it is not a target we aim at, it is the job that enforces it, and we keep a record of each time it runs. Thirty days is how long a coach has to review a session and add feedback to it; it is a coaching window, not an archive. The only exceptions are an earlier deletion you ask for, an expressly offered different period you choose, or a narrow legal preservation duty. Exact behaviour, backups and exceptions are in the Privacy Notice.
  4. Deleting our copy is not deleting every copy, and there are two different deletions. The first is that 30-day server deletion: it removes what we hold and nothing else, because a recording already saved on a phone or tablet is that device's copy and is not ours to reach into. The second is permanent erasure, which you ask for in the app: it destroys our copies and instructs every device signed in to the responsible accounts to destroy theirs the next time it connects, however long it has been offline. The start, its timing and its movement numbers survive both.
  5. Who can ask for permanent erasure. Once a start is assigned to a rider, only the account that holds that rider — the rider themselves, or the adult who manages their profile — can erase its video. A club, a coach or the operator whose device recorded the start cannot, even though they may be able to see it, because assignment to a rider is permanent and the rider's history belongs to the rider. A start that has not yet been assigned to any rider can be erased by the account that owns the session.
  6. Numeric history remains available after the video has gone; that is the point of the short video period. Measurements are estimates from camera footage and can be affected by position, light, clothing, occlusion, calibration, frame rate and model limitations. Check the replay; do not rely on a result where it is visibly wrong.
  7. We may reanalyse a run to correct an error or apply an improved measurement method. We will distinguish materially recalculated results where they affect comparisons. We will not present future coaching models as established expert advice without appropriate evidence.
  8. You can report a wrong result, assignment or unsafe recommendation at [SUPPORT EMAIL]. We may remove a result from comparisons while it is investigated.

5. Club sessions, links and sharing

  1. A club may see a run recorded in a session it operated for the limited session, coaching, support and safeguarding purposes stated at capture. That access does not make the run club property and does not permit publication, advertising, sale or unrelated reuse.
  2. Linking a rider to a club roster is a separate, revocable choice. The app must clearly identify the club, categories shared, purposes, roles able to view them and effect of unlinking before the link is made.
  3. Sharing runs from other sessions or the rider's wider history with a club requires a separate switch. It is off by default. The rider or managing guardian can switch it off; the club must then lose access promptly, although it may retain a minimum audit or legal record explained in the Privacy Notice.
  4. A club must not download, screen-record, photograph, copy or share a replay outside the authorised audience except with specific valid permission or where law requires it. A coach's personal device or messaging group is not an approved archive unless expressly authorised in the club agreement.
  5. If club terms or policies conflict with these terms about Perfect Start data, the more protective rule applies unless law requires otherwise. The Club Schedule below governs organisation operators.

6. Movement telemetry and product improvement

  1. Analysis creates numeric measurements: body landmark positions, wheel and motion tracks, timing, velocity, technique traces, calibration and quality information. While connected or reasonably connectable to a rider, account, club, video, time, place or persistent run identifier, this is personal data even if the file contains no name.
  2. We use linkable telemetry to provide the replay, maintain the rider's history, secure and troubleshoot the service, and improve measurement only under the purposes, lawful bases, access restrictions and retention periods in the Privacy Notice.
  3. Research use is an optional, unticked choice. We propose a research process to improve measurement and, after evidence and review, help develop future coaching models. The final product will state whether this is opt-in or offers a right to object before collection; it will not hide research permission inside acceptance of these terms.
  4. Before telemetry enters an indefinitely retained research dataset, we will remove the source and replay video, audio, account/rider/club identifiers, exact event time and location, persistent run identifiers and lookup links; generalise rare metadata; assess whether the record can single out or reconnect a person using reasonably available means; restrict access; and prohibit re-identification.
  5. Only data meeting that anonymisation standard may be kept indefinitely as non-personal product research data. Merely replacing a name with a code is pseudonymisation, not anonymisation. If residual data remains personal, it stays subject to the published retention period and privacy rights.
  6. If anonymous data can no longer be linked to a person, we cannot locate it in response to a later individual deletion request. We will explain that before the research choice. Withdrawal will stop future use and remove linkable records where required; it cannot retrieve a record that has already been irreversibly anonymised.
  7. We will not use a child's footage or identifiable telemetry for advertising, facial recognition, identity verification, insurance, employment, eligibility or sale to data brokers. Any materially new research purpose requires a fresh assessment and notice, and where required a new choice.

7. Acceptable use and intellectual property

You must not:

The service, models, analysis, scoring, coaching logic, replay design, branding and software belong to us or our licensors. We grant a limited, revocable, non-transferable right to use the service and authorised replays for personal training or the club purposes in the applicable plan. We may monitor service patterns to protect riders, security and our models. We may suspend immediately where we reasonably believe model extraction, child harm, unlawful content, a security attack or serious privacy misuse is occurring, with review and appeal information where appropriate.

8. BMX safety and service limitations

  1. BMX riding carries risks of falls, collision and injury. Use a mechanically safe bike, suitable protective equipment, a stable phone position and a safe clear area. Follow the venue, governing-body and qualified coach's rules. Children require appropriate adult supervision.
  2. Do not use a public road, obstruct a track, attach equipment to a live or moving gate, or position a phone/person where a rider may strike them. Stop if conditions, equipment or advice appear unsafe.
  3. Outputs are informational estimates, not medical or professional safety advice. Seek a qualified professional for pain, injury, fitness, technique or equipment concerns.
  4. Nothing here excludes statutory service standards, remedies or liability that applicable consumer law does not allow us to exclude.

10. Suspension, cancellation and deletion

  1. You may stop using the service and request closure through [CONTROL/EMAIL]. Closing an account does not automatically decide ownership of another rider's profile; we will verify and resolve managed profiles first.
  2. We may suspend proportionately to investigate safety, privacy, security, fraud, non-payment or material breach. Except for urgent harm or extraction risk, we will explain the issue and give a reasonable chance to fix it.
  3. On termination, service access ends. Rider-owned history must not be forfeited merely because a club subscription ends. Export, deletion, retention and any lawful exceptions follow the Privacy Notice and final paid-service terms.

11. Liability, complaints and general legal terms

  1. Final warranty exclusions, liability caps and indemnities require counsel after the provider, insurance, paid plans and launch countries are fixed. No draft cap applies to fraud, death or personal injury caused by negligence, data-protection obligations, or any matter that cannot lawfully be limited.
  2. Contact [SUPPORT EMAIL] first with a complaint. Privacy and safeguarding contacts and regulator rights are in the Privacy Notice. Nothing restricts a mandatory right to use a court, regulator or alternative dispute process.
  3. Final governing law and courts: [COUNTRY/JURISDICTION], subject to the mandatory rights of a consumer's home country. The UN Convention on Contracts for the International Sale of Goods [DOES NOT APPLY, IF COUNSEL APPROVES].
  4. If a provision is unenforceable, the rest remains effective. Delay is not a waiver. We may transfer these terms as part of a genuine business transfer with notice and no reduction in rights; you may not transfer an account without our agreement. These terms, the Privacy Notice, final plan terms and any signed Club Schedule form the agreement, but do not override separately recorded optional choices.

Club Schedule

This Schedule applies when a club, affiliate or event operator (“Organisation”) opens or administers a Perfect Start session.

A. Authority and safeguarding

  1. The Organisation will appoint an owner, safeguarding contact and trained operators; maintain accurate roles; remove access promptly when a person leaves; and never share accounts.
  2. It will complete venue and activity risk assessments, follow governing-body safeguarding rules, verify the capture authority required by the app, respect a rider's refusal, and provide a non-filmed route where practicable.
  3. It will not rely solely on membership, event entry or a general photography waiver as permission for Perfect Start processing.

B. Data roles and instructions

  1. Before launch, the parties will sign a data-role schedule identifying, for each flow, whether they are independent controllers, joint controllers or controller/processor. The real purposes and decisions prevail over labels.
  2. Each party is responsible for its controller duties. Where Perfect Start acts solely as processor for a defined flow, an Article 28-compliant data processing schedule covering instructions, confidentiality, security, subprocessors, rights assistance, breach support, deletion/return and audit will apply.
  3. The Organisation may use session data only for the purposes presented to the rider and its lawful safeguarding duties. It may not use Perfect Start data for advertising, selection, discipline, insurance, employment, facial recognition, unrelated profiling or model training.

C. Access, sharing and incidents

  1. Organisation access is least-privilege and time-limited. Roster membership and wider-history sharing are rider-controlled. The Organisation must not attempt to restore access after unlinking or withdrawal.
  2. Exports, screenshots, personal-device copies and onward disclosure are prohibited unless a documented product control and valid authority expressly permit them. The Organisation must keep its own approved records out of informal messaging and photo libraries.
  3. The Organisation will report suspected misassignment, accidental bystander capture, lost devices, unauthorised access, disclosure or safeguarding concerns to [INCIDENT CONTACT] immediately and in any event within [HOURS], preserve appropriate evidence, and not notify affected people or regulators on our behalf unless agreed or legally required.

D. Commercial and exit terms

  1. Final order form, authorised sites, term, fees, taxes, usage/fair-use measure, support level and equipment responsibility: [TO BE COMPLETED]. No prototype allowance is contractual.
  2. When the relationship ends, the Organisation loses access, but riders retain their own histories. Each party deletes or retains its own records under the agreed role schedule and law. The Organisation must return equipment and remove local exports.
  3. Organisation insurance, liability allocation, indemnities, audit rights and governing law require counsel and the final operating model.
